Copyright & DMCA Policy

These guidelines govern ownership of intellectual and industrial property on Trigglow, the licenses users grant, the rules for store content, and the notice-and-takedown procedure under Regulation (EU) 2022/2065 (DSA) and the Digital Millennium Copyright Act (DMCA).

1

1. Trigglow Intellectual Property

All rights in Trigglow’s software, source code, technical architecture, interfaces, trademarks, logos and designs belong exclusively to Trigglow Studios or its licensors. Reverse engineering, decompiling, systematic data extraction (scraping) and any unauthorized exploitation of the platform are prohibited.

2

2. User Content & Technical License

Ownership: you keep all intellectual property and copyright in the media files (videos, audio, images and text) you upload to the platform.

Technical service license: by uploading content you grant Trigglow a non-exclusive, royalty-free, worldwide license, valid while you keep the file on the platform, limited to the rights of reproduction, technical transformation (transcoding, formatting, thumbnails, compression), caching and communication to the public through the OBS Studio browser source. Its sole purpose is to host, process and display your alerts.

Rights warranty & indemnity: you represent and warrant that you hold all copyrights, related rights, music licenses (including synchronization and public performance) and image permissions needed for the files you use, and you will hold Trigglow harmless from any claim, penalty or damages arising from content uploaded without the authorization of its rightful owners or collecting societies. This warranty expressly extends to texts and character strings entered for playback through text-to-speech (TTS), for example protected song lyrics or literary works.

3. Store Content License

Unless the creator states another license in the product description, buying digital content in the store grants the buyer a personal, non-exclusive, non-transferable license to use it in their own streams. Resale, sublicensing, redistribution or making the file publicly available to third parties is prohibited.

Overlay packs: open “.overlaytrigglow” files (the ones exported as your own backup or to share with friends) may not be sold or distributed at scale, inside or outside Trigglow. To distribute a pack to many people, free or paid, publish it in the Trigglow store or sell it with licence codes. Trigglow limits how many accounts can import the same open file, may block its import and, if it detects this use, suspend the account distributing it. Bought or redeemed packs are for the account that acquired them and may not be exported, resold or republished.

4. Infringement Notices (Notice & Takedown / DMCA / DSA)

Trigglow respects third-party rights and diligently removes infringing content. Under Article 22 of Regulation (EU) 2022/2065, notices from “trusted flaggers” recognized by EU authorities are processed and resolved as a priority. If you believe content hosted or displayed through Trigglow infringes your rights, send a notice to dmca@trigglow.com with:

  • Sufficient identification of the protected work you believe is infringed.
  • The precise location of the allegedly infringing content (exact URL, overlay slug or details that let us find it).
  • Your contact details (full name or company name, address, phone and email).
  • A statement that you act in good faith and that the disputed use is not authorized by the owner, its agent or the law.
  • A statement that the information in the notice is accurate and that you are the rights owner or authorized to act on their behalf, under your legal responsibility.
  • Your physical or electronic signature, or that of your authorized representative.
5

5. Counter-Notice & Reinstatement

If you believe your content was removed by mistake or misidentification, you can send a counter-notice to dmca@trigglow.com with:

  • Identification of the removed content and where it was before removal.
  • Your contact details (name, address and email).
  • A reasoned statement, under your legal responsibility, that the content was removed by mistake or misidentification, showing your license or the applicable legal exception.
  • Your formal submission to the jurisdiction of the competent courts (including, if the complainant is based in the United States, acceptance of the applicable court jurisdiction), your undertaking to accept service of process from the person who sent the original notice, and your signature as the account holder.
6

6. Handling a Counter-Notice

On receiving a valid counter-notice, Trigglow will forward it to the original complainant. If they do not show within 10 to 14 business days that they have started legal action before the competent authorities, Trigglow may reinstate the removed content. Every decision is communicated to the user with its reason and can be contested under the Acceptable Use Policy.

7

7. Repeat Infringers

In line with applicable law (Art. 23 DSA and the DMCA), Trigglow will permanently terminate the accounts of those who repeatedly infringe third parties’ intellectual property rights.

8

8. Nominative Use & Third-Party Trademarks

Kick, Twitch, YouTube, Discord, Spotify, OBS Studio, Corsair Gaming, Elgato, Stream Deck, Nightbot, Botrix and Streamlabs are trademarks of their respective owners. They are mentioned only descriptively, to indicate interoperability and technical compatibility (fair, nominative use), without implying sponsorship, endorsement, affiliation or any commercial link.
